Terms of service

Effective 2 September 2026. These Terms govern purchase and use of HVAC Growth OS from CoilPath. By paying a setup fee, starting a monthly plan, or otherwise using the service, you agree to them.

1. Who we are

CoilPath is the trade name for this service. No separate legal entity has been formed as of the effective date. We do not publish an EIN. Notices and CAN-SPAM mail:

2. The service

HVAC Growth OS is a monthly marketing system for owner-operated residential HVAC shops in the United States. Four jobs:

1. Google Business Profile posts (8×/month) — all plans
2. Job-photo social assets (12×/month) — Growth and Ops+
3. After-job review-request SMS — all plans
4. Missed-call text-back SMS — Growth and Ops+

Starter is posts + review SMS. Growth adds job-photo social and missed-call text-back. Ops+ adds lead routing into Jobber or Housecall Pro and a quarterly automation tweak. Setup (every plan) includes a profile audit and filling categories, services, hours, and NAP. That setup is not a map-pack ranking service.

Quarterly landing-page refresh (Growth and Ops+) means copy and layout on one URL you already have. It is not a new website.

3. What we do not do

CoilPath does not answer phones, staff a call center, roll 24/7 trucks, walk job sites, manage Meta or Google ads, buy reviews, take genuine negative reviews down, keyword-stuff your business name, or guarantee map-pack or Google rank. We do not invent installs you did not do. We do not monitor or triage emergencies. If a message we send for you includes an emergency path, it tells the recipient to call 911 and that a reply of EMERGENCY pages your shop’s owner, not CoilPath.

4. Fees, cancel, refunds

• Starter: $497 setup + $497/month
• Growth: $497 setup + $997/month (default)
• Ops+: $1,497 setup + $1,497/month

Setup covers the build (profile audit, SMS copy, photo pipeline, first calendar). It is not an ads credit. It is not refundable once work starts.

The plan is month-to-month after setup. Cancel before the next billing date; we finish the month already paid. No extra 30-day notice. No annual lock.

5. Your obligations

• You are an owner-operated residential HVAC business, not a consumer.
• You give us access to Google Business Profile, a shared photo folder, and (for Growth/Ops+) a number you already use for jobs.
• Review and missed-call texts send from that shop-controlled number, not a CoilPath blast list. You are responsible for TCPA/consent on numbers you text. We do not buy lists. We do not text homeowners from a CoilPath-owned marketing number.
• You do not ask us to gate reviews, buy reviews, invent jobs, or use another shop’s photos as yours.
• Job photos: see the Photo license.

6. Reviews and SMS

Review texts are the same ask to everyone, after the tech has left, with a direct Google link and STOP language. No quotas, no “mention the tech,” no gating. Missed-call text-back is a text, not dispatch.

7. Intellectual property

CoilPath retains its trade name, product name, templates, and systems. You retain your shop name, Google profile, and photos, subject to the Photo license. Specimens on our marketing materials are labeled SPECIMEN / NOT A LIVE CLIENT and are not your work product or proof you hired us.

8. Disclaimers

The service is provided as-is. We do not warrant leads, revenue, review count, or search position. Reports describe what shipped. We do not pad them with impressions from posts nobody saw. If a month was thin on photos, the report says so.

9. Limitation of liability

To the maximum extent permitted by law, CoilPath is not liable for lost profits, lost leads, lost rank, or other indirect or consequential damages. Direct damages are capped at the fees you paid us in the three months before the claim. This cap does not apply to our fraud or willful misconduct, or to liability that cannot be limited under applicable law.

10. Indemnity

You will defend and indemnify CoilPath against claims arising from your customer list, your SMS consent, your photos, or your instruction to post or text something that violates law or a platform’s rules.

11. Term

Either party may end the monthly plan as in section 4. We may suspend or terminate immediately if you use the service for fake reviews, purchased lists, or other abuse.

12. Changes; law; contact

We may update these Terms. Material changes apply on the next billing cycle after we post them. United States law applies. These Terms are for US businesses. Week-1 outbound does not target the EU or UK.
